Slip and Fall Victim Awarded $15 Million – Denver Injury Attorney
The Denver Post has reported that a Cheyenne truck driver, Holly Averyt, was awarded $15 million from a Weld County jury for injuries suffered “while delivering frozen food to a Greeley Wal-Mart store.” Averyt’s attorney, Greg Gold, said that “Averyt has undergone four surgeries and is unable to work as a truck driver” due to her injuries. The jury found “that Wal-Mart had failed to use reasonable care to protect Averyt against a danger on its property” and awarded her millions of dollars for non-economic, economic and physical impairment losses. A spokesperson for Wal-Mart, Greg Rossiter, said that they might appeal the verdict.

Denver Premises Liability Attorneys Recover $1.2M for Victim of Furniture Store Accident
A Centennial jury has awarded $1.2 million in the case of a 71-year-old woman who sustained a major hip fracture after falling from an unmarked ledge in an American Furniture Warehouse store.
The verdict was announced in Arapahoe District Court on March 18, 2016 after a five-day trial.
Centennial resident, Violet Yokomichi, was injured while furniture shopping on Dec. 30, 2012 at American Furniture Warehouse at 8281 South University Blvd., Centennial.
The store alleged that the publicly accessible area where Yokomichi fell was not a walkway and denied any negligence.
The jury found that the area of the store where Ms. Yokomichi fell was dangerous. The jury also found that Ms. Yokomichi sustained permanent physical impairment and other damages.
“I thank the jury for recognizing how this injury has limited my mobility and my ability to participate in and enjoy activities that were a major part of my lifestyle” Yokomichi said. “I also hope the verdict sends a message to American Furniture to improve store safety. A casual day of shopping should not turn into a life-changing injury.”
The verdict is believed to be one of the largest of its kind against the Englewood, Colorado-based retailer.
Yokomichi was represented by attorneys Pamela Maass and Sommer D. Luther of The Gold Law Firm, LLC, based in Greenwood Village. The Gold Law Firm, LLC previously obtained the largest premises liability verdict against Wal-Mart in a case where a jury returned a verdict of $15,000,000.00 against the retailer.
American Furniture was defended by attorney J. Scott Lasater of Lasater & Martin, based in Highlands Ranch.
