What is Subrogation in an Injury Case?

Posted on April 22,2022 in Uncategorized

If you suffered an injury in a car accident in Denver, you may wonder who ultimately pays for your injuries and damages. After a car accident, your health insurance company might bear the burden of paying for your medical bills while you are in the hospital.

However, if the accident was not your fault, they will not want to bear this burden alone. If they find out that you received money in an injury settlement, they will want their cut. This is where subrogation comes into play.

Subrogation is a legal process where one party stands in the place of another party to assert a legal claim or right. In the context of an injury case, this means that if you are injured in a car accident and your insurance company pays for your medical bills, they may then seek reimbursement from the at-fault driver's insurance company through subrogation.

In some cases, this can happen even if you have not yet settled your personal injury case with the at-fault driver.

The purpose of subrogation is to ensure that the party who ultimately bears the responsibility for the damages pays for them. In many cases, this will be the at-fault driver's insurance company. However, there are some situations where subrogation may not be available or may not make sense.

How Can I Help My Personal Injury Case Succeed?

Posted on April 15,2022 in Uncategorized

Many injured accident victims want to know how they can help their personal injury case succeed. By far, the best way you can ensure a successful claim is to contact an experienced Denver personal injury lawyer.

Your attorney can fight to get you the compensation you need after a serious accident. But what else can you do to help your attorney?

5 Ways to Help Your Personal Injury Case Succeed

  1. Follow Doctor's Treatment Plan. It is important to follow your doctor's treatment plan after you have been involved in any type of accident. This may include taking medication, physical therapy, and/or surgery. Following your doctor's orders ensures that you heal properly and avoid further injury. It also signals to the insurance companies that you are taking your health and recovery seriously.
  2. Keep Good Records. Good documentation helps your attorney build a case. This includes keeping receipts for medications, medical bills, mileage records, and any other expenses you have during your recovery. Keep a journal documenting your pain and your recovery. This journal can help establish pain and suffering, as well as emotional distress after an accident.
